招聘外国人就业及应当承担的违法责任 , 主要包括:
Firstly foreigners must have complete documents to get employment in our country.Article 41 of the Exit and Entry Administration Law stipulates \"Aliens who work in China shall obtain work permits and residence permits for work in accordance with relevant regulations. No unit or individual may employ a foreigner without a work permit or a residence permit for work.\"
Article 8 of the Provisions on the Administration of Employment of Aliens in China also states that aliens who are employed in China shall enter The country with occupational visas (if there is an agreement on mutual visa exemption the agreement shall be followed) and only after entering the country can they obtain employment Permits for Aliens and residence certificates for aliens in China.
首先 , 外国人在我国就业必须证件齐全 。
《出境入境管理法》第41条规定:“外国人在中国境内工作 , 应当按照规定取得工作许可和工作类居留证件 。 任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人 。 ”
《外国人在中国就业管理规定》第8条也指出:在中国就业的外国人应持职业签证入境(有互免签证协议的 , 按协议办理) , 入境后取得《外国人就业证》和外国人居留证件 , 方可在中国境内就业 。 ”
Secondly foreigners must meet the statutory conditions for employment in our country.
Article 6 and Article 7 of the Provisions on the Administration of Employment of Foreigners in China respectively stipulate that: \"The posts employed by the employing units by foreigners shall be those posts that have special needs and are temporarily in short supply in China and do not violate the relevant regulations of the State. The employing units shall not employ foreigners to engage in commercial artistic performances with the exception of persons conforming to paragraph 3 of Article 9 of these Provisions (i.e. foreigners who are approved by the Ministry of Culture to perform commercial artistic performances on the basis of a Temporary Business Performance Permit). \"
\"Foreigners are required to meet the following conditions for employment in China:
(1) having reached the age of 18 and in good health;
(2) having the professional skills and corresponding work experience necessary for the work;
(3) having no criminal record;
(4) having a definite employing unit;
(5) hold a valid passport or other international travel documents that can replace the passport.\"
其次 , 外国人在我国就业必须满足法定条件 。
《外国人在中国就业管理规定》第6条、第7条分别规定:“用人单位聘用外国人从事的岗位应是有特殊需要 , 国内暂缺适当人选 , 且不违反国家有关规定的岗位 。 用人单位不得聘用外国人从事营业性文艺演出 , 但符合本规定第九条第3项规定的人员除外(即经文化部批准持《临时营业演出许可证》进行营业性文艺演出的外国人 。 )”
“外国人在中国就业须具备下列条件:
(一)年满18周岁 , 身体健康;
(二)具有从事其工作所必须的专业技能和相应的工作经历;
(三)无犯罪记录;
(四)有确定的聘用单位;
(五)持有有效护照或能代替护照的其他国际旅行证件 。 ”
Thirdly the employing unit shall go through legal formalities for the employment of foreigners.
Article 5 of the Provisions on the Administration of Employment of Foreigners in China stipulates \"An employing unit shall apply for an employment license for the foreigner to be employed and shall not employ the foreigner until it has been approved and obtained an Employment License for foreigners of the People's Republic of China.\"
Article 45 of the Exit and Entry Administration law also states: \"Units employing foreigners for work or recruiting foreign students shall report relevant information to local public security organs in accordance with regulations.\"
Article 43 of the Act provides that: \"An alien who commits any of the following acts shall be illegally employed:
(1) To work in China without obtaining a work permit or a residence permit for work as required;
(2) Working in China beyond the limits of the work permit;
(3) Foreign students work in China beyond the prescribed post scope or time limit in violation of the regulations on work-study programs.\"
再次 , 用人单位应当为外国人就业办理合法手续 。
《外国人在中国就业管理规定》第5条规定:“用人单位聘用外国人须为该外国人申请就业许可 , 经获准并取得《中华人民共和国外国人就业许可证书》后方可聘用 。 ”
